Why isn't 'sampling' regarded as stealing?

Yes. The ones that are still protected by copyright.
In an ideal world, i'd agree. If someone lifted a three second part of a recording of say The Four Seasons, & used it on their own recording, how would anyone know which of the dozens of recordings it came from.
